Actor Ashish Kapoor
The Delhi court on Saturday has sent Actor Ashish Kapoor to 14 days of judicial custody in connection with an alleged gang rape.
The order was passed by Link Judicial Magistrate First Class (JMFC) Payal Singhal at Tis Hazari Court, following the end of his police custody.
Kapoor was taken into custody on September 2 from Pune, following an FIR registered on August 11, 2025. The complaint, filed by a woman, includes serious charges under sections related to rape, gang rape, and causing hurt.
The woman alleged that she was invited to a party near Kapoor’s residence, where her drink was spiked. She claimed she lost consciousness and was later sexually assaulted in a washroom by multiple individuals.
Initially, the complainant reportedly named more than one person in her statement. However, she later revised her version of events, accusing only Ashish Kapoor of the assault. Based on her revised statement, police intensified their investigation and arrested Kapoor.
After his arrest, the Delhi Police moved an application requesting five days of custodial interrogation. The agency sought time to:
However, the court granted only four days of police custody on September 3, instead of the requested five. He was originally scheduled to be produced in court on September 7, but police presented him a day earlier.
The court also gave permission to conduct a potency test on Kapoor, as requested by investigators.
During the earlier hearing, advocates Deepak Sharma, Rajan Oberoi, and Somesh Oberoi, who represented Kapoor, objected to the need for custody.
Advocate Sharma argued, “Recovery of the mobile phone cannot be effected from the accused because, as per the status report, it was in possession of co-accused Kapil Gupta and Ritu Gupta.”
He further pointed out that Kapil Gupta, a pilot and one of the co-accused, had already been granted anticipatory bail, undermining the necessity of Kapoor’s continued custody. Ritu Gupta, another co-accused, is reported to be a businesswoman.
Kapoor’s legal team had also moved a plea for interim protection from arrest, but the application became infructuous after his arrest in Pune.
The investigation into the case remains ongoing, with police still examining digital evidence and the roles of other individuals mentioned in the initial complaint.
