Rape & Kidnapping: Assam Court Sentences Police Constable to 20 Yrs Imprisonment

A court in Assam’s Kokrajhar district sentenced a police constable to 20 years imprisonment for kidnapping and raping a girl.
Special Judge J Koch pronounced the verdict through fast-track proceedings after convicting constable Banjit Das under Section 6 of the Protection of Children from Sexual Offences Act, 2012 (POCSO).

Das was sentenced to 20 years’ rigorous imprisonment and fined Rs 10,000. In the event of default, he will face an additional two months of simple imprisonment.
Furthermore, the court found Das guilty of kidnapping the girl under Section 363 of the IPC and sentenced him to three years in simple imprisonment plus a Rs 2,000 fine.

In case of default, he will face an additional one month of simple imprisonment, the order said.

The judge order that both the sentences will run concurrently.

On October 10, 2019, the victim’s father filed a FIR at Bogribari police station, reporting that his daughter had gone missing after visiting her uncle’s home.
Das was later discovered to have kidnapped the girl with the intention of marrying her, and she was raped after being held at an undisclosed location, according to the prosecution.
