Rohini Court Convicts A Woman In NDPS Case

A Rohini district court has convicted a woman, Sita, in a 2020 narcotics case involving the recovery of 1.8 kg of ganja.

The case was registered at Narela Industrial Area Police Station on September 15, 2020.

Special Judge (NDPS) Dhirendra Rana convicted the accused on September 27, holding that the prosecution had conclusively proved its case through police testimony, forensic evidence, and the accused’s past conduct.

“The testimony of Prosecution Witnesses Head Constable Hemraj, Woman Constable Manoj Kumari, SI Sandeep Kumar, and HC Ram Chander coupled with the unimpeached FSL result conclusively establishes that on September 19, 2020, the accused was found in possession of an intermediate quantity of ganja,” the court observed.

The court noted that the contraband was packed in 261 small polythenes, along with some loose quantity, suggesting that the accused was selling the drug for commercial benefit. It also considered her previous record, pointing out that she had been booked in seven earlier cases under the Punjab Excise Act.

Sita was charged under Section 20 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

While the prosecution argued that the recovery and investigation were carried out without procedural lapses, the defence questioned the chain of custody, the absence of independent witnesses, and alleged contradictions in police testimonies.

The court will next hear arguments on the quantum of sentence.
