The Supreme Court on Friday agreed to form a bench to hear the case of the removal of the Secretary of the Delhi government’s Services Department.
The government removed Services Secretary Ashish More a day after the Supreme Court’s decision in the squabble between the Delhi government and the Lieutenant Governor granted the Aam Aadmi Party (AAP) control over the transfer and posting of officers in the National Capital Territory (NCT).
Today, Senior Advocate Abhishek Manu Singhvi, appearing for the Delhi government, informed a Bench led by Chief Justice of India (CJI) DY Chandrachud that if the removal of the Secretary was found to be in violation of the Court’s previous orders, there could be contempt under Article 141 (law declared by the Supreme Court to be binding on all courts) of the Indian Constitution.
The CJI replied that he would form a bench to hear the matter next week.
In a landmark decision, the Supreme Court’s Constitution Bench ruled on Thursday that the Delhi government would have control over all services in the national capital, including the Indian Administrative Service (IAS), with the exception of land, police, and law and order.
