SC to Hear Maharashtra Govt’s Plea Against Order Discharging GN Saibaba on Thursday

The Supreme Court will hear on Thursday Maharashtra government plea challenging Bombay High Court order discharging the former Delhi University professor Prof GN Saibaba in an alleged ‘Maoist link’ case.

The bench of Comprising Justices MR Shah and CT Ravikumar will hear the plea.

On 16 October the apex court had suspended the Bombay high court order acquitting professor G.N. Saibaba in an alleged ‘Maoist link’ case.

Mr. Saibaba has been in custody for over seven years since his arrest in May 2014. A trial court had found him guilty and sentenced him to life imprisonment in 2017.

Earlier the High Court set aside the lower court judgment and ordered the release of Mr. Saibaba and other accused persons. The High Court had found that sanction for Mr. Saibaba’s prosecution was non-existent at the time the court took cognizance of the case and even while charges were framed against him.
