Additional Sessions Judge Vishal Gogne at Rouse Avenue Court overturned a magistrate court’s decision that acquitted Gambhir in a case involving alleged fraud with flat buyers.

The court rejected the magistrate court’s order and directed a fresh investigation into the charges.

While dismissing the appeal, the court observed that the magistrate’s order lacked sufficient reasoning in deciding the charges against Gambhir and suggested that his role in the allegations warrants further investigation.

The case involves real estate companies Rudra Buildwell, HR Infracity, and UM Architects, whose directors are accused of defrauding flat buyers.

The court noted that Gambhir is the only accused who had a direct association with investors as the brand ambassador, yet was acquitted. The magistrate’s order did not mention that Gambhir received Rs 4.85 crore from the company and had to return Rs 6 crore.

The accused allegedly promoted and advertised a housing project called Sera Bella in Indirapuram, Ghaziabad, Uttar Pradesh, in 2011, which was renamed Pavo Real in 2013. The court stated that since the allegations revolve around the offense of fraud, it was crucial for the charge sheet and order to specify if any part of the fraudulent amount had reached Gambhir.
