STAY ON ORDER PASSED BY TELANGANA HC; SUPREME COURT CLEARS OTT RELEASE OF THE MOVIE JHUND

The Supreme Court in the case Super Cassettes Industries Pvt Ltd (T Series) versus Nandi Chinni Kumar and others observed and stay on an interim order passed by the Telangana High Court against the movie and further the court cleared the decks for the OTT release of the film “Jhund”.

The CJI allowed the urgent listing of the movie which is being released on OTT on May 6. Sundaram had submitted, heir challenge to the movie’s release was already dismissed and wanted to go to compromise a one-line order has been passed by the High Court as the OTT release as announced in March and it has already been released in theatres.

the film was released in theatres on March 4 as the Trial Court refused his plea to recall the settlement and allowed the film to be released in theatres an injunction against the theatre release of the film was being sough earlier. The plea stated alleging breach of the terms of the settlement in an earlier case against the filmmakers.

On April 29 an interim order was passed. The Nandi Chinni Kumar moved the High Court challenging the trial court’s order.

on a petition filed by Hyderabad-based filmmaker Nandi Chinni Kumar alleging copyright infringement against the makers of Jhund. On 29th April Justice P Sri Sudha, a bench comprising of single judge passed the interim order on a petition filed.

the bench observed while admitting a Special Leave Petition filed by the film’s producer Super Cassettes Industries Pvt Ltd (T Series). The bench has posted the petition for disposal to next Thursday (May 12) after issuing notice to the respondent Nandi Chinni Kumar. The Impugned Order shall remain stayed if any of the Respondent is a money claim, if in any case it claimed.

The HC has overlooked the principles with regard to grant of interim relief and it appeared before the bench that the Impugned Order is clearly against the balance of convenience.

The Bench comprising of Justice Indira Banerjee and the justice AS Bopanna on April 29 stayed the interim order of status quo passed by the Telangana High Court.

Furthermore, it was stated in an order of the High Court’s that the next hearing of the matter i.e., 8th June,2022. The bench further said that let the status quo be maintained by both the parties.

Harsh Kaushik, Madhu Garodia, Pranjit Bhattacharya, Sachin Akhoury and EC Agarwala and the C Aryama Sundaram, a Senior Advocate and Advocates Mahesh Agarwal appeared for the film maker in the Supreme Court.
