Supreme Court Appointed Former Judge Nageswara Rao To Oversee Election Of Hyderabad Cricket Association

The Supreme Court in the case Hyderabad Cricket Association v. Chairman Cricket Club AndAnr observed and has appointed retired Supreme Court judge, Justice L. Nageswara Rao as a single-member committee for overseeing the process of election of the Hyderabad Cricket Association.
The bench comprising of Justice S.K. Kaul, Justice Manoj Misra and Justice Aravind Kumar in the case observed and has stated that soSupreme Court Appointed Former Judge Nageswara Rao To Oversee Election Of Hyderabad Cricket Associationme method of conducting election has to be devised. Thus, the counsel, Senior Advocate, Mr. Siddhartha Dave submitted before the court that if the election can be conducted under the supervision of Justice Rao.
It has also been pointed out by Sr. Advocate Jayant Bhushan that the election has not been conducted and in the meantime the period of 3-year term of the supervisory committee is being over. Further, it has been submitted by him that the previous president of the Association, Mohd Azharuddin is running it with the aid of one or two other people.
It has also been made clear by the bench that it was open to the retired judge for seeking assistance from whichever authorities he thinks fit. However, in the order, it was categorically mentioned that the expenses would be paid by the Hyderabad Cricket Association.
Further, the court noted that if the judge needs some directions from this court the matter be placed before this court limited for that purpose only. It being needless to say that the Association will render all the necessary support for the Ld. Judge for carrying out the exercise.
Therefore, all singing powers were to be assigned to the retired Judge.
Before the court, Mr. Bhushan submitted that it is recorded in the order that the ‘supervisory committee should go now, adding to which the bench clarified that the said committee will no longer survive.
However, Justice Kaul was quite disappointed that all the sports associations in the country are before Constitutional Courts. Adding to which, Justice Kaul reckoned, ‘Every Association of sports is litigating instead of doing the sports.’
Last Year, the Apex Court had also appointed Justice Nageswara Rao in September, to take over the process of amending the constitution of the Indian Olympic Association (IOA), wherein preparing its electoral rolls; and for conducting of elections to its executive body.
Accordingly, the court listed the matter to be next heard on 02.03.2023.
