SUPREME COURT DISMISSED VIJAY MALLYA’S PETITIONS AFTER LAWYER SAYS HE HAS NO INSTRUCTION FROM CLIENT

The Supreme Court in the case observed and has dismissed two special leave petitions being filed by fugitive businessman Vijay Mallya, after his lawyer informed the bench that no instructions has been received to him from the client despite several attempts. The bench headed by Chief Justice of India DY Chandrachud in the matter observed and has dismissed the petition filed for non prosecution. Therefore, the court allowed the application which is filed by the lawyer wherein seeking discharge from the case. However, the plea has been filed by Mallya against the judgment delivered by the Karnataka High Court on October 5, 2018, wherein approving the directions issued by the Debts Recovery Appellate Tribunal asking him to deposit Rs.3,101 Crore as a pre-condition for allowing his application for restoration of the appeal which is filed against the recover steps which are taken by the State Bank of India. It has been held by the Supreme Court in a separate case in July 2022 had sentenced Vijay Mallya to 4-months imprisonment for contempt of court for violating the orders of the Court. Further, it has also been directed by the court that the Government authorities for taking steps to secure the presence of Mallya in India. In that case as well, the lawyer appearing for Mallya allowed discharge and the Court appointed an amicus curia as Mallya who did not appear. Therefore, Mallya is yet to appear in India to serve the sentence in the case of contempt, Mallya is facing extradition proceedings in UK at the instance of the Government of India.
