Supreme Court: Refused Urgent Listing For PIL To Ban Stubble Burning; “You Think It Is Going To Stop”

The Supreme Court observed and refused to grant urgent listing to a petition seeking directions to stop stubble burning in neighbouring states to control the air pollution in Delhi.
The bench comprising of CJI, Justice D.Y. Chandrachud, Justice Hima Kohli and Justice J.B. Pardiwala was hearing the matter mentioned by Advocate Shashank Shekhar Jha.
In the present case, the CJI asked the counsel as the matter was mentioned, “So what is your solution to the Delhi pollution?”
Adding to it, the counsel submitted for the banning of stubble burning can be effective in tackling the pollution issue that engulfs Delhi.
However, the submissions made by counsel did not impress the CJI.
The CJI remarked, So, you think, it is going to stop? So, we ban it? We enforce it against every one farmer in UP and Punjab?
Further, the CJI being of the opinion that some genuine solutions are needed to be implemented to fight pollution. “This is not being the way, we need to find some genuine solutions.”
Adding to it, the CJI stated that there are some things that courts can do and some things courts can not do. The court will take it up immediately. The court handle matters which are judicially amenable.
