Supreme Court Refuses To Entertain Petition By Uddhav Sena For An Early Listing

The Supreme court on Monday refuses to entertain mentioning by Uddhav Sena for an early listing of appeal against the Election commission order recognizing Shinde as the real Sena & allotting the ‘bow and arrow symbol to Shinde.

“Mr.Singhvi. You have to come under the mentioned list. Come tomorrow. The rule is applicable to all”, CJI said

The former Maharashtra Chief Minister Uddhav Thackeray on Monday filed a plea against the Election Commission’s decision on the name & symbol of Shiv Sena.

Uddhav Thackeray told the media on Saturday that he would file a petition against the commission’s decision in Supreme Court.  

The Maharashtra Chief Minister Eknath Shinde priorly filed a caveat for the Shiv Sena election symbol and name case in Supreme Court. Therefore, Shinde stated in his application stated that if Uddhav Thackeray files a petition in Supreme Court challenging the decision of the Election Commission then without hearing his side, the supreme court shouldn’t issue any order.

Therefore, before the BMC elections on Friday, Uddhav Thackeray suffered a major setback. Certainly, the party symbol “bow & arrow has gone to the Shinde faction. The Election Commission stated in its order that the Shiv Sena’s present constitution is undemocratic. It’s been tarnished for undemocratically appointing people of faction as the office bearers without elections.

The decision of the Election Commission is considered as historic as it can lead to a far-reaching impact on the parties. The Election Commission suggested all political parties follow basic principles while creating democratic values in the party’s internal affairs.

Earlier, the Election Commission had frozen Shiv Sena’s election symbol bow and arrow. The Shinde faction gave the symbol of two swords and a shield. Similarly, the Uddhav Thackeray camp was given the election symbol of a burning torch. By-elections were held in the Andheri East assembly seat in November last year.
