The Supreme Court in the case Mumbai City District Gymnastics Association and Ors. Versus The Deputy Charity Commissioner Mumbai and Ors observed in a writ petition filled by the Mumbai City District Gym Association, challenging the process which was notified on 29.04.2022. Thereafter the top court refused to entertain the plea.
The vacation bench comprising of Justice Ajay Rastogi and the Justice BV Nagarathna contended while hearing the case that the bench does not appreciate filling petitions against election matters as these people are politicizing the games and when failed the Bombay High Court, they came to the Supreme Court.
The Bench further contended that when the High Court hasn’t granted you any indulgence, why the Supreme Court should entertain the petition.
The Counsel, appearing for the Association submitted before the court that the certain people who are not eligible were also being permitted to cast vote, in terms of the letter.
The bench in its order further remarked that however, nothing the election program was to be held and June 4 was the date of voting and the date of filling the nomination paper was over.
The Counsel, appearing for the petitioner tried to persuade the bench in terms of the letter certain people who are not eligible and are also being permitted to cast a vote Thereafter, the bench is not going to express any opinion at this stage but if the person is aggrieved by the election, he has the liberty to approach the court as The present petition questions the election of the trust which was published on April 29, 2022, and as per the election program the election is to be held, nomination papers are over & the date of voting is on June 4.
