Supreme Court seeks Centre’s response in NEET BDS 2021 to reduce percentile for qualification

The Supreme Court in the case Kunal v Union of India & Or’s observed in challenging the 7th May, 2022 notice the Ministry of Health and Family Welfare’s to lower the percentile for qualification of NEET BDS Course for the academic session 2021-2022. The court sought Center’s response in a petition preferred by BDS aspirants.

After the note has been prepared, results have been declared and all the 111 seats in government colleges have been allotted. While hearing the matter it was said that the reduction of percentile, while submitting a note which dealt with figures pertaining to the total number of seats in the academic year 2019-20, 2020-21, ASG Bhati the matter was called for hearing.

Students don’t want to go to these deemed universities with the kind of fees etc., while issuing notice in the plea the bench said further the bench said that how many seats are in private universities, we will ask them to place full data of the total vacant seats, the bench further stated that a notice will be issued to them and will ask them to file a reply.

It is said that out of 20k seats only 9k seats have been filled, DCI has also acknowledged it issued by the Dental Council of India wherein it had made a proposal for lowering the percentile cut off, while referring to the letter dated 04.06.2022

ASG Bhati stated that if proper notice is issued, we’ll have time to prepare affidavits. We just have figs of the AIQ, while responding to the remarks made by the bench.

in 2019-2020, there were almost 7 lakhs eligible candidates but still there were vacant seats the bench further noted that there might be some reason as to why this is happening.

The bench comprising of Justice DY Chandrachud, Justice Sanjiv Khanna and the justice Surya Kant observed while issuing a notice in the plea and asked the center to file an affidavit by the following specifications:

after deducting the admission granted for MBBS Courses (BDS Courses), the total number of candidates.

In All India Quota and State Quota, the total number of vacant seats.

In government colleges on one hand & private/deemed colleges on the other hand, the number of seats remaining.

In The Supreme Court Today, What Transpired?

A notice was issued by the bench comprising of Justice DY Chandrachud and the Justice Hima Kohli issued, the bench issued the notice regarding the direction considering the fact that last date for BDS admissions have been extended to 05.15.2022 from 04.11.2022 and that the Executive Committee of the Dental Council of India (DCI), in its meeting held on April 6, recommended the Center to reduce the qualifying percentile.

On 1st May, 2022 the Supreme Court asked the Ministry of Health and Family Welfare to consider afresh its decision to not lower the qualifying cut-off percentile for admissions to the Bachelor of Dental Surgery (BDS) within a period of 1 week.
