sexual assault case

The Motor Accident Claims Tribunal (MACT) has awarded a compensation of ₹59.2 lakh to the family of a man who was killed in a road accident.

Additionally, the tribunal has directed a payment of ₹10 lakh to the widow of the deceased for injuries sustained during the incident. The compensation is to be jointly paid by the owner of the offending vehicle and its insurer.

Details Of The Accident

The accident occurred when the deceased, a 35-year-old man, was riding his motorcycle and was struck by a speeding vehicle. The impact led to fatal injuries to the rider and caused significant harm to his wife, who was riding pillion. The couple was returning home from a local market when the incident took place.

Tribunal’s Ruling

The MACT held that the accident was caused due to the rash and negligent driving of the offending vehicle. The tribunal emphasized the responsibility of vehicle owners and insurers in ensuring compensation for victims of road accidents. The compensation amount was calculated based on the income of the deceased, the extent of injuries sustained by the widow, and other relevant factors.

This ruling underscores the importance of holding errant drivers accountable and ensuring that victims and their families receive timely compensation. The decision also highlights the role of the MACT in providing justice to individuals affected by road accidents.

Further Legal Proceedings

The insurance company and the vehicle owner have been directed to deposit the compensation amount within a specified timeframe. Failure to comply with the tribunal’s order may result in legal consequences. The case sets a precedent for similar incidents, reinforcing the legal framework for compensation in road accident cases.
