The Tripura High Court in the case Gau Gyan Foundation Vs Union of India observed and has allowed a PIL filed by Delhi-based NGO Gau Gyan Foundation for ensuring welfare measure for cattle, which includes proper transaction.
The division bench comprising of Acting Chief Justice T. Amarnath Goud and Justice Arindam Lodh in the case observed and has directed the State to immediately take steps in this regard under the Prevention of Cruelty to Animals (Regulation of Livestock Markets) Rules 2017 and other notifications which are to be issued within a period of 3 months by the Centre.
The court observed that apart from transportation, the petitioner organisation in the plea also drew the attention of the court to other issues like market sheds of cattle not being properly maintained.
It has been submitted by the counsel appearing for the State that the measures are being taken in all market yards for proper maintenance and these measures have been subsisting for the last several decades.
However, it has also been argued by the petitioner that there being no specific contention with regard to how the markets and other societies which have been authorized by the State Government and which are maintaining their market yards and the transporting cattle and for forthcoming of other animals.
It has also been directed by the court that it being the State to identify the traders obtaining license, maintenance as well as transportation, wherein the court finding force in the argument of the petitioners.
