The Delhi High Court on Wednesday sought the National Investigation Agency’s (NIA) reply on a bail plea filed by two alleged Kashmiri terrorists in connection with a UAPA case filed in 2021.
A division bench of Justice Siddharth Mridul and Justice Talwant Singh issued notice on the appeals moved by alleged Haris Nisar Langoo and Zamin Adil against the trial court’s ruling denying them bail on March 3. On October 22, 2021, the NIA arrested both Langoo and Adil.
The case is listed for further consideration on July 18, 2023.
The case involves to an FIR filed in October 2021 under UAPA Sections 18, 18A, 18B, 20, 38, and 39, as well as Indian Penal Code (IPC) Sections 120B, 121A, 122, and 123.
The FIR was filed by the NIA in response to a Ministry of Home Affairs (CTCR Division) order alleging that cadres of various terrorist organisations, including Lashkar-e-Toiba (LeT), Jaish-e-Mohammed (JeM), Hizab-ul-Mujahideen (HM), Al Badr, and their affiliates, are active in J&K and elsewhere.
According to the NIA, Langoo deliberately participated in a conspiracy developed by terrorists and other co-accused individuals to carry out multiple attacks in the Kashmir valley.
He has also been accused of aggressively promoting terrorist organisations ideology in accordance with the directives of various terrorist outfits in order to create unrest in the Kashmir valley and other parts of the country.
Against Adil, the NIA claims that incriminating material was recovered from him during the raids and searches. Adil allegedly said that he was closely linked with a network of terrorist outfits and gave essential support to them.
Co-accused, Mohd Manan Dar, a 25-year-old Kashmir-based photojournalist, was granted bail in the case by the trial court in January.
