Air Pollution Case: SC Directs Centre To Provide Accommodation To CAQM Officials

The Supreme Court on Thursday instructed the Union Government to ensure suitable accommodation is provided to members of the Commission for Air Quality Management within 3 months, acknowledging the challenges faced by the officials in securing housing in the capital.

A bench comprising Justices Abhay S. Oka and Ujjal Bhuyan issued the order after senior advocate and amicus curiae Aparajita Singh informed the court that CAQM officials, including the chairperson, were struggling to find proper residential arrangements in Delhi.

“We are aware that many government officers face difficulties in securing accommodation in Delhi. We direct the Union of India to arrange appropriate housing for CAQM officers within three months,” the bench stated.

Established under the CAQM Act, 2021, the Commission for Air Quality Management in the National Capital Region and adjoining areas plays a critical role in combating air pollution. It serves as a central authority for:

  • Monitoring Air Quality
  • Coordinating among state and central agencies
  • Conducting research
  • Issuing directions
  • Handling public complaints related to pollution

The CAQM is empowered to take enforceable actions aimed at improving air quality and ensuring public health in one of the most polluted regions in the world.

The Court’s directive underscores the importance of supporting this key regulatory body through logistical and infrastructural support, enabling its officers to effectively perform their duties.
