The Government of Assam and Meghalaya got a big relief from the Supreme Court on Friday. The Supreme Court has stayed the Meghalaya High Court order in which court had stayed the Memorandum of Understanding (MOU) between the governments of Assam and Meghalaya to settle the border dispute.
During the hearing of the case, Supreme Court Chief Justice DY Chandrachud asked SG Tushar Mehta who had challenged the MOU in the High Court. To which the SG said that some citizens.
SG said no demarcation has been done. All political decisions were taken just under the MoU.
Meanwhile, The counsel appearing for the petitioner said that the MOU is not in conformity with Article 3 of the Parliament. In which there are procedures and rules regarding the border of the states.
The CJI said that we put an interim stay on the order of the High Court.
Earlier a petition filed in the High Court regarding the border dispute between the two northeastern states has claimed that it violates the provisions of the Sixth Schedule of the Constitution, which deals with special provisions for the administration. Meghalaya Chief Minister Conrad K. Sangma and Assam Chief Minister Himanta Biswa Sarma had signed a memorandum of understanding in March, demarcating the border in at least six of the 12 disputed sites, often leading to skirmishes between the two.
