CJI Advocates Advance Letters For Case Withdrawals To Streamline Court Proceedings

The Chief Justice of India Sanjiv Khanna on Wednesday stressed the importance of preemptive communication in streamlining court processes.

He recommended that lawyers submit advance letters for case withdrawals instead of making oral submissions during hearings.

The CJI, who has been implementing procedural changes to improve efficiency in the Supreme Court, had already announced on November 12 that no oral submissions would be allowed for urgent listings and hearings. Lawyers were advised to submit requests via email or written letters instead.

While hearing a transfer petition in a family dispute case, the CJI suggested that lawyers file advance letters for case withdrawals. The counsel in the case informed the bench that the parties had resolved their issues and wished to withdraw the petition.

Granting the request, the CJI remarked that submitting an advance notice would improve the efficiency of the court.

“If you have any such requests, you can always give a letter to the Court Master, one day or two days in advance,” the CJI said. “That will help us resolve the matter or avoid unnecessary review of the files.” He reiterated that submitting withdrawal requests in advance would save time and help manage the court’s workload.

At the Constitution Day event organized by the Supreme Court Bar Association (SCBA) on Tuesday, the CJI also addressed the challenges faced by members of the Bar.

He expressed his commitment to addressing these issues and sought their cooperation to bring about positive changes in the judicial system.
