CPI Moves Supreme Court Against Waqf (Amendment) Act, 2025

The Communist Party of India (CPI) has approached the Supreme Court challenging the constitutional validity of the Waqf (Amendment) Act, 2025. The petition was filed by CPI General Secretary D. Raja through advocate Ram Sankar.

In its petition, the CPI argues that the amended law violates the fundamental rights of nearly 50 lakh Muslims in Tamil Nadu and around 20 crore Muslims across the country. The party has raised concerns over the provisions that have been added to or removed from the original Waqf Act of 1995, stating they could negatively impact the Muslim community’s rights and autonomy over waqf properties.

This legal move follows the CPI’s earlier support for a resolution passed by the Tamil Nadu Legislative Assembly on March 27, 2025. The resolution, initiated by Chief Minister M.K. Stalin and backed by the CPI and its ally Dravida Munnetra Kazhagam (DMK), urged the Union Government to withdraw the Waqf (Amendment) Bill, 2025.

The Supreme Court is scheduled to hear a total of ten petitions challenging the Waqf (Amendment) Act on April 16. The bench will be led by Chief Justice of India Sanjiv Khanna, along with Justices Sanjay Kumar and K.V. Viswanathan.
