The Supreme Court today issued notice to the Delhi Police on the bail plea filed by Jawaharlal Nehru University (JNU) activist Umar Khalid in connection with the Delhi Riots conspiracy case.
The bench of Justices Hima Kohli and AS Bopanna sought the response of the Delhi Police and posted the matter for further consideration after the period of 6 weeks.
Though the bench permitted liberty to Khalid for moving vacation bench for an urgent hearing, Khalid’s counsel Senior Advocate Kapil Sibal stated that the matter could be heard after the summer vacation of the Court set to commence next week.
The Court ordered that “Issue notice. Liberty to move vacation bench.”
Sibal said that, “After vacation is fine.”
Further, the bench stated that “Returnable in 6 weeks then.”
Khalid moved to the apex court against an October 2022 Delhi High Court judgment that denied bail to him.
Therefore, the arguments in the High Court had gone on for more than 20 days.
Khalid approached the High Court challenging the expulsion of his bail application by the Karkardooma court in March 2022.
However, he was arrested by the Delhi Police in September 2020 and charged with criminal conspiracy, unlawful assembly, rioting as well as several segments of the Unlawful Activities (Prevention) Act (UAPA).
He has remained in jail since then.
