EVM VVPAT JUDGEMENT STANDS RESERVED

In March 2023, the Association for Democratic Reforms (ADR) brought a significant case before the esteemed Supreme Court of India, advocating for the authentication of electronic voting machines (EVMs) with the implementation of voter-verifiable paper audit trails (VVPATs). The primary aim behind this initiative was to fortify the integrity and credibility of electoral processes across the nation. Central to the petitioners’ proposal was the suggestion to incorporate barcodes onto VVPAT slips, a measure intended to streamline and enhance the verification process.

During today’s proceedings, the Supreme Court panel diligently scrutinized the Election Commission, seeking elucidation before delivering its verdict. Justice Khanna, in particular, posed several pertinent queries to the Commission. He sought clarity on fundamental aspects such as the precise location of the microcontroller—whether it resided within the Control Unit or the VVPAT—and whether it possessed programmable capabilities. Additionally, Justice Khanna inquired about the availability and functionality of Symbol Loading Units, integral components of the electoral machinery. Another crucial aspect probed by the Justice was the maximum duration for which the machines ought to be retained, highlighting the importance of maintenance and preservation protocols.

Upon the conclusion of the day’s deliberations, the Supreme Court conveyed its stance, articulating a cautious yet proactive approach towards addressing the issues raised. The Court stated, “Let us see what can be done. If any safeguards are deemed necessary, we’ll evaluate what measures are requisite to strengthen the current electoral system.” This statement underscored the Court’s commitment to ensuring the robustness and reliability of electoral processes, while also acknowledging the need for potential enhancements.

As the proceedings drew to a close, the Supreme Court reserved its judgment, signifying a period of contemplation and deliberation before a final decision is rendered. This prudent approach reflects the gravity of the matter at hand and the Court’s steadfast dedication to upholding the democratic principles enshrined in the Constitution of India.
