For Practicing Anti-Competitive Android Mobile Phone System Goggle To Deposit 10% Rs.1,338 Crore Fine

The Supreme Court on Thursday asked Goggle to deposit 10% Rs 1338 crore fine imposed by the CCI for practicing anti-competitive Android mobile phone system within a week. The bench asked NCLAT (National Company Law Appellate Tribunal) to decide the Google’s appeal against CCI (Competition Commission of India) order by Marech 31. NCLAT was correct in not granting interim stay of CCI order, as the same cannot be said to be without jurisdiction or evidence, the bench saidNCLAT had earlier posted the hearing of Google’s appeal on April 3 while directing it to deposit Rs 134 crore by January 19. The tech giant Google’s challenging Competition Commission of India’s decision to impose Rs 1,338 crore penalty finding its practices relating to Android mobile devices unfair and anti-competitive. Google sought stay of an interim order of NCLAT, which asked it to deposit 10% of penalty amount by January 19 and refusing to stay CCI penalty. Earlier the top court had asked the tech giant if it would be ready to practise the same regime in India as it has in Europe. “Please reflect on this and come back”, the bench added The Competition Company of India had on October 20 imposed a penalty of ₹1,337 crore (about $ 161 million) besides issuing ten non-monetary directions (remedial directions) against Google that, among other things, required it to change its business model entirely.
