Imran Pratapgarhi Instagram ‘Poem’ Case: SC Shields Congress MP, Emphasises Importance Of Creativity

The Supreme Court on Monday questioned the Gujarat Police for registering an FIR against Congress MP Imran Pratapgarhi over an instagram post that included a poem titled ‘Ae Khoon Ke Pyase Baat Suno.’

The top court bench of Justice AS Oka remarked, ‘HC has not appreciated the meaning of the poem.’

While adjoining the matter, the top court emphasised the importance of creativity in such matters, adding, ‘Ultimately, creativity is also important.’

In an oral remark the bench noted that the poem was not aimed at any particular community and conveyed an indirect message about violence.

Senior Advocate Kapil Sibal, who appeared for Pratapgarhi in this matter expressed concern over the High Court’s decision to reject the plea to quash the FIR.

To this, the Gujarat Government’s counsel sought more time to respond.

Bench asked the Gujarat government’s counsel to ‘apply your mind to the poem.’

Last month, the top court directed the Gujarat Government not to take any coercive action against Congress MP.

Jamnagar police, on January 3, had filed an FIR against Pratapgarhi for allegedly posting on social media a video recording of his poem ‘Ae khoon ke pyase baat suno (Hey blood-thirsty ones, listen)’.
