‘Make Representation Before Govt’: SC to Petitioners Seeking Restrictions on OTT Platforms

The Supreme Court on Friday directed a petitioner, who raised concerns about imposing restrictions on over-the-top (OTT) platforms due to the display of nudity and inappropriate scenes, to present their case before the government.

A bench comprising Justices B R Gavai and Sandeep Mehta was informed by the counsel representing the petitioner in court that the plea addresses whether OTT platforms should be permitted to broadcast or display content unsuitable for viewers of all ages without any limitations.

The counsel alleged that OTT platforms are airing inappropriate scenes containing nudity.

What did the Court Said?

The bench advised the petitioner, “Go to the censor board,” suggesting they seek directions on viewer control. It further inquired, “You want some directions on viewer control?” and advised the petitioner to submit a representation to the government.

Subsequently, the petitioner’s counsel requested permission to withdraw the plea while retaining the option to approach the government with a representation regarding the issue.

The top court granted permission for the petitioner to withdraw the plea with the liberty to submit a representation to the government. It emphasized that if such a representation is made, it must be addressed in accordance with relevant laws.

Upon the bench informing the petitioner’s counsel that the plea raised concerns about a movie, the lawyer clarified that the issue pertains to nudity depicted on OTT platforms.
