‘Opt Mediation for Child Custody, Supreme Court tells to Parents’

American resident Richard Gere had filed a special writ petition in the Supreme Court challenging the Mumbai High Court order seeking custody of the minor child. Mumbai High Court rejected Richard Gere’s petition. Richard Gere had reached the Supreme Court against this order.

While hearing the petition on Friday, 19-12-2024, the Supreme Court bench of Justice Surya Kant and Justice KV Vishwanathan has ordered American citizen Gary and Indian origin mother Aishwarya Krishnan Gary regarding the custody of the minor child. Both the parents – the father – should resort to mediation for the custody of the child. And sitting there the problem should be resolved amicably.

The bench also said that both the parties should try to find a solution to their problem through the mediation of a former judge of the same court. The place of arbitration can be Hyderabad.
The Supreme Court also directed that no criminal case would be registered against the petitioner.

Supreme Court further said, ‘Meanwhile, petitioner as well a respondent number 2 will ensure that the cases filed by them against each other are deferred till further orders.

The court has fixed the next hearing of this case on January 29.
