The Supreme Court on Friday rejected a 2019 plea filed by a then two-year-old child, who sought action against illegal organ trafficking in the country.
Additionally, the child asked for a Central Bureau of India investigation into such cases.
A bench comprising Justices Sanjay Kishan Kaul and Sudhanshu Dhulia opined that the Supreme Court could not be the ultimate solution for all societal ills.
The Court orally remarked, “Supreme Court is not the panacea for all evils. This looks like using the child as a front for other motives.”
Consequently, the Court ruled to dismiss the petition filed under Article 32 of the Constitution of India.
Despite this dismissal, the Court acknowledged that the relevant authorities may address the concerns raised in the petition by referring to the recommendations put forth by the Justice JS Verma Committee report.
Previously, a bench led by Justice SA Bobde had issued a notice regarding the matter back in 2019. The petition, which was filed by Master Devarsh Jain through his mother, urged the apex court to take necessary actions against the increasing incidence of organ trafficking in India.
Specifically, the petitioner sought a CBI investigation into such cases, expressing concern over instances where doctors illegally extracted kidneys and other organs from financially deprived patients, subsequently selling them to wealthier patients.
