SC On Krishna Janmbhoomi-Shahi Idgah Matter: Consolidating All Suits Benefits Both Sides

In the Mathura Shri Krishna Janmabhoomi Shahi Idgah Dispute Case, the Supreme Court on Friday expressed reluctance to interfere with the order of the Allahabad High Court to club all suits relating to the matter.

The top court slated the matter for further hearing on April 1.

During the hearing of the case, the bench of Chief Justice of India Sanjeev Khanna asked the lawyer appearing for the petitioner as to why there should be interference on the issue of simultaneous hearing of all the cases.

On which the lawyer appearing for the petitioner said that cases of dissimilar nature should not be heard together. This will create complications.

CJI Khanna said that there is no complication. The court said that it will benefit both parties as many proceedings can be avoided.

The court said that if necessary, it will take up this matter later.

Muslim side challenged the order of Allahabad High Court. The High Court had considered the petitions filed by the Hindu side worthy of hearing.

Case History

On August 1, the Allahabad High Court took up 18 cases pending before the lower court and considered worthy of hearing.

In the last hearing, the Supreme Court had rejected the demand of the Muslim side to stay the transfer of petitions from the lower court to the High Court.

Hindu side lawyer Vishnu Shankar Jain has filed a second caveat in the Supreme Court on the Mathura Krishna Janmabhoomi and Idgah dispute.

Earlier, Rashtriya Hindu Sena President Vishnu Gupta had filed a caveat in the Supreme Court in the same matter.

The caveat filed by Vishnu Shankar Jain and Vishnu Gupta states that if the Shahi Eidgah Committee or any other petition comes to the Supreme Court against the Allahabad High Court’s order of clubbing 18 pleas and hearing them together, then they should also be heard before any order is passed.
