SC Reserves Order On Delhi’s Govt. Plea Challenging Nominations Power To LG In MCD

The Supreme Court today reserved its verdict on the Aam Aadmi Party (AAP) government’s plea challenging the nominations of 10 ‘aldermen’ by Lieutenant Governor LG Saxena to the Municipal Corporation of Delhi.

Therefore, the bench observed that “Is the nomination of 12 specialized people in MCD is of that much concern to the Centre? Actually, giving this power to the LG would adequately mean that he can weaken the democratically elected Municipal Committees because they (aldermen) will have voting powers also.”

The bench of Chief Justice DY Chandrachud, Justices PS Narasimha, and JB Pardiwala made observations while reserving its verdict on the plea of the Delhi government.

Therefore, the top court asked about the “source of power” of the LG under the Constitution and the law to nominate aldermen to the MCD without the aid & advice of the elected government.

It was hearing a petition filed by the AAP government challenging the nominations by the LG to the MCD.
