The Supreme Court has recently upheld the bail granted to Simarjeet Singh Bains, former Punjab Member of Legislative Assembly (MLA) and Lok Insaaf Party leader, in connection with a rape case.
A bench of Justice AS Bopanna and Justice MM Sundresh affirmed the bail and advised the survivor’s counsel that she could approach the Punjab and Haryana High Court for bail cancellation if Bains violates any of the bail conditions. The bench stated that they are not inclined to interfere at this stage, thereby disposing of the petition.
The Supreme Court heard the survivor’s appeal against a Punjab and Haryana High Court order from January last year, which had granted bail to Bains in the 2021 rape case. The High Court had found no evidence of trauma or signs of forcible assault through the complainant’s body language or conduct.
Bains was arrested in July 2022 in connection with the case. In a previous instance, the Supreme Court strongly criticized Bains for filing numerous cases against the complainant, while Bains alleged that the complainant was involved in false cases and job rackets. The top court has stayed the proceedings in all cases filed against the complainant.
