The Supreme Court on Thursday has overturned a controversial order by the Rajasthan High Court, which had quashed sexual harassment case based on a settlement between the parties involved.
Bench of Justice CT Ravi Kumar, noted that the order in question was not in accordance with the law.
The Court directed that the FIRs and criminal proceedings should proceed as per law.
Bench also noted that the Court had refrained from commenting on the merits of the case.
Court appreciated the role of amicus curiae (court-appointed advisor) R Basant for assisting the court.
The issue originated from an appeal involving the sexual harassment case of a 15-year-old girl, which led to a FIR filed by her father.
Later, a compromise was reached between the girl’s family and the accused, prompting the accused to approach the Rajasthan High Court seeking to dismiss the case.
