The Supreme Court on Friday dismissed a petition seeking an FIR against Justice Yashwant Varma, after a large stash of cash was found at his residence following a fire incident earlier this month.
A bench comprising Justices Abhay S. Oka and Ujjal Bhuyan stated that a panel of judges, set up by the Chief Justice of India (CJI), is already investigating the matter. The court emphasized that any decision on filing an FIR would be made only after the completion of the inquiry.
Court’s statement
“The in-house inquiry is ongoing. If the report finds any wrongdoing, an FIR can be registered, or the matter can be referred to Parliament. At this stage, it would not be appropriate to entertain this writ petition,” the bench said.
The Supreme Court made it clear that the judicial probe should be allowed to reach its conclusion before any legal action is considered.
Background of the Case
The controversy arose after a fire broke out at Justice Varma’s residence, leading to the discovery of a large sum of cash. The incident raised questions, prompting calls for an independent investigation. However, the Supreme Court maintained that the internal judicial panel must complete its findings before any further steps are taken.
The outcome of the judicial inquiry will determine the next course of action. If any irregularities are found, the Supreme Court may direct the registration of an FIR or refer the matter to Parliament for further deliberation.
Currently, the court has ruled out immediate legal action, urging patience while the ongoing investigation unfolds.
