Burden on the SC is increasing due to Trial & HC are Reluctant to Grant Bails

Justice Bhushan R Gavai highlighted a concerning trend in the judicial system, noting a steady increase in bail pleas reaching the Supreme Court due to a reluctance to grant bail in lower courts. He mentioned that each Supreme Court bench now deals with 15 to 20 bail matters daily. Justice Gavai referenced the challenging landscape where bail is increasingly difficult to obtain even in high courts, leading to a rise in pending bail cases at the apex court.

Drawing parallels with the fearless and impartial nature of Ramshastri Prabhune, the esteemed chief justice of the Maratha Empire, Justice Gavai questioned why there should be hesitation in granting bail, especially considering instances where individuals spend years in jail before their trials conclude.

Echoing Justice Gavai’s concerns, Justice Abhay Oka highlighted the growing number of marriage-related disputes, particularly in urban areas, stressing the need for more family courts nationwide. He also urged the legal community to prioritize reverence for the Constitution over ritualistic practices, suggesting the commencement of any legal endeavor with homage to this foundational document as a means of upholding its principles and values, especially as the nation celebrated 75 years of its adoption.
