NGT Directs ‘No Parking Contractor Encroachment’, Authorities to Ensure Compliance

The National Green Tribunal on Monday directed the traffic commissioner concerned and the Municipal Corporation of Delhi authorities to ensure that there is no encroachment upon the open and green cover of a building by the parking contractor in the Laxmi Nagar District Centre.

The NGT’s attention was drawn to a plea presented by the Laxmi Nagar DDA Building Office Owner Welfare Society, asserting that the parking contractor of the building situated in the District Centre unlawfully occupied a green open area with a “malafide intention,” rather than utilizing the designated parking space.

In a recent ruling passed by a bench led by Chairperson Justice Prakash Shrivastava, the NGT observed that it established a joint committee in April 2023, consisting of representatives from the DDA, MCD, and the Delhi Pollution Control Committee (DPCC), tasked with assessing the factual circumstances and recommending necessary corrective measures.

The bench, also included judicial members Justice SK Singh and Justice Arun Kumar Tyagi, alongside expert member A Senthil Vel, referred to the committee’s report dated April 27.

As per the report, the parking area had been “temporarily demarcated.”

But, according to the report, to ensure there was no encroachment by the contractor, the DDA had to repair the broken fencing.

The green panel stated, “The contractor cannot be permitted to encroach upon any area having the green cover. Hence, the Traffic Commissioner concerned and the MCD are directed to ensure that no such encroachment by the parking contractor is done and that the parking is done only in the demarcated area.”
