Accident Accused gets Conviction After 20 yrs, Sentence will be Announced on 22nd December

A Delhi court has convicted an accused in a 20-year-old road accident case. The court said that argument on the sentence in this case will be held on December 22.

Metropolitan Magistrate Deeksha Sethi said in her order that the prosecution has proved that the accused driver was driving the tractor negligently at the time of the accident and in doing so caused grievous hurt to the victim, therefore the accused is held guilty. .”

The court convicted the accused under sections 279, 338 of the Indian Penal Code. The court also noted that there is nothing on record to show that the death of the victim was due to the injuries sustained in the accident. The Court observed that the testimony of the eye-witness son of the deceased was consistent The court said that the testimony of a single eyewitness was completely reliable. The court said that conviction could be based on his sole testimony.

The prosecution had said in the court that the tractor driver fled from the spot after seeing Naval Kishore Sharma seriously injured. In this case, the police of Uttam Nagar police station had registered a case against the tractor driver.
